Does my septic system affect my rental permit?
Often, yes. Stone County’s health department wants a septic inspection report from a licensed inspector with every vacation rental permit application (Vacation Rental Ordinance §4.4.6). In unincorporated Taney County, a nightly rental’s guest limit gets cut if the wastewater system can’t handle the full number (Zoning Regulations §024.020 C).
If the house is hooked up to a public sewer, the septic rules here don’t apply to it.
Who issues septic permits around Branson?
| Where | Office | What they handle | Source |
|---|---|---|---|
| Taney County | Taney County Environmental Services, 207 David St., Forsyth, (417) 546-7238 | Reviews and issues permits for new and repaired systems, and inspects them. | Taney County |
| Stone County | Stone County Health Department. North office: 109 E. 4th St., Galena, 417-357-6134. South office: 701 Old Wilderness Rd., Reeds Spring, 417-272-0050 | Every system needs a permit, whether it’s new, repaired or a replacement. A permit is good for one year. | Stone County |
| Statewide | Missouri Department of Health and Senior Services, Onsite Wastewater Treatment Program, 573-751-6095 | Sets the state minimum standards. In most counties the local health department issues the permits. | DHSS |
The state standards cover new systems and major changes to old ones. You generally need a permit before you build or repair a system, and a county can set stricter rules than the state. Whoever installs it has to be registered with DHSS (DHSS).
The three-acre exemption doesn’t cover lakefront lots
Missouri law exempts some single-family lots of three acres or more from the state septic rules. Lots next to lakes run by the Corps of Engineers or a public utility are left out of that exemption (RSMo §701.031). Taney County puts it plainly: property that borders a Corps or public utility lake needs a permit no matter how big it is (Taney County). Table Rock Lake is a Corps lake (Corps of Engineers).
Taney County also requires a permit for lots under three acres, for commercial projects under 3,000 gallons a day, and for more than one structure on less than 10 acres per structure. Commercial systems at 3,000 gallons a day or more go to the Missouri Department of Natural Resources instead (Taney County).
Does septic size limit how many guests I can have?
In unincorporated Taney County it does, by rule. The zoning code allows 2 people per dwelling unit plus 2 per bedroom, never more than 20. That number is “further limited” by the wastewater system’s capacity, the parking and the fire district’s limit, and the lowest one wins (§024.020 C). The Taney County page has the rest of the nightly rental rules.
The state sizing rule shows why bedrooms matter. A house system is designed for 120 gallons a day per bedroom, with a 240-gallon minimum. When a home holds more than 2 people per bedroom, the design flow is based on the maximum occupancy at 60 gallons per person per day. The bedroom count is the one an appraiser gives (19 CSR 20-3.060). So a three-bedroom house is sized for 360 gallons a day. Sleep 8 people there and the same rule figures 480.
In Stone County the rental permit caps a house at 2 people per bedroom plus 4 (Vacation Rental Ordinance). The county’s septic ordinance counts as a bedroom “any room within a dwelling that might reasonably be used as a sleeping room” (Onsite Wastewater Ordinance §5.2.5), so a bunk room or finished bonus room may count.
What inspection do I need to turn a house into a rental?
In Stone County, the permit application needs an inspection report from a licensed onsite system inspector. The county’s definition of an inspection includes a water volume test to see whether the soil absorption field can take the expected flow. If the system turns out to be insufficient, the first repair permit fee is waived (Vacation Rental Ordinance §4.2.3, §4.4.6). The health department’s septic page links its list of licensed inspectors (Stone County). The Stone County page lists everything else that goes with the application.
Taney County zoning has a related rule. When a lot has no public sewer, a zoning application has to come with a Certificate of Approval from the Taney County Wastewater Permitting Authority (Zoning Regulations Art. 005 B).
Unconfirmed: whether Taney County requires a septic inspection before a home starts operating as a nightly rental. We didn’t find one in the zoning regulations or on Environmental Services’ page. Call Environmental Services at (417) 546-7238 before you apply (Taney County).
Inspection or evaluation?
Ask for an inspection. DHSS says an inspection includes a hydraulic load test. An evaluation skips it, so the soil part of the system isn’t tested. Anyone doing these private assessments for a real estate deal has to be licensed by DHSS, and copies of the report go to DHSS and the local agency. Most local agencies no longer do real estate transfer inspections themselves (DHSS). If you’re financing, DHSS suggests asking your lender which kind it wants.
Buying a lake house with septic in Stone County
Stone County’s septic ordinance requires a Property Transfer Certificate before most sales of a property served by a septic system. These are the rules in §5.11 of the 2009 ordinance (Onsite Wastewater Ordinance):
- You don’t need one if the health department gave the system final approval 10 years or less before closing.
- The application needs a pumping receipt and a licensed inspector’s report dated no more than 90 days before you apply.
- The certificate is good for four years.
- If the system doesn’t pass, the requirement can be waived when the buyer signs an agreement with the health department to repair or replace it within a year of closing.
The application form is linked from the health department’s septic page. We left fees off this page because the ordinance dates from 2009. Ask the health department for current fees.
If the house has a dock, the dock permit doesn’t pass to you automatically either. See docks and the lake.
